    Clarification regarding Proposal in the Finance Bill 2020

    The Finance Bill, 2020 has proposed that an Indian citizen shall be deemed to be resident in India, if he is not liable to be taxed in any country or jurisdiction. This is an anti-abuse provision since it is noticed that some Indian citizens shift their stay in low or no tax jurisdiction to avoid payment of tax in India.

    The new provision is not intended to include in tax net those Indian citizens who are bonafide workers in other countries. In some section of the media the new provision is being interpreted to create an impression that those Indians who are bonafide workers in other countries, including in Middle East, and who are not liable to tax in these countries will be taxed in India on the income that they have earned there. This interpretation is not correct.

    In order to avoid any misinterpretation, it is clarified that in case of an Indian citizen who becomes deemed resident of India under this proposed provision, income earned outside India by him shall not be taxed in India unless it is derived from an Indian business or profession. Necessary clarification, if required, shall be incorporated in the relevant provision of the law.

    Liberalization of e-visa to India

    The Embassy of India would like to inform the Members of Indian Community in Niger that in order to liberalize e-visa the Government of India has decided to bring out the following changes in the validity period and fees of e-visa:

    (a)  A short duration e-visa for tourist, with one-month validity with visa fee of USD 25 has been introduced.

    (b)  To encourage off-season (April-June) tourism, visa fee of USD 25 would be reduced to USD 10 during this period.

    (c)  Validity of the regular e-visa with fee of USD 80 has been increased from currently permissible 1 year to 5 years with multiple entry.

    (d)  Fee for one year e-Tourist visa has been reduced from USD 80 to USD 40.

    Registration for Electoral Roll as per Representation of the People Act, 1950.

    Under Section-20A of the Representation of the People Act, 1950, every overseas elector of India (after fulfilling certain criteria) is entitled to have his/her name registered in the electoral roll of his/her constituency w.e.f. 10th February, 2011.  The prescribed application i.e. Form-6A for registration in the Electoral Roll alongwith guidelines for the applicants is available on the website of the Election Commission of India (ECI) i.e http://eci.nic.in .  It may also be noted as per ECI’s instructions self-attestation of documents by the applicant is sufficient while applying for registration.
